First we had false accusations against someone for a crime that actually occurred.  They might be "framed" for it with false or fabricated evidence, or suborned testimony.  The authorities making the accusations might even have carried out the crime themselves.

Then we had suspected crime, where there was no proof, but if you fit the "profile", or "life-style", you could be executed.  Such is the criteria now used by Obama's drone assassination program.

This was followed by the concept of pre-crime, where if it was suspected you might do something in the immediate future, a decision based on a vague, ever changing, ever self-justifying set of criteria, you could be punished for it. 

Which was extended further by the concept of future-crime, where if it was suspected you might possibly do something at some point months or even years from now, you could be punished for it. 

Finally we have arrived at the ultimate concept for the authority's definition of crime.  Fake crime, a concept where no crime has even been committed, or suspected.  You're simply accused of things that have never actually occurred, where no proof is needed (or could) be offered, but you go to jail for it anyway.
